Purchase Process for MAINSTONE Products

Returns and Withdrawal

Withdrawal is subject to a series of exceptions, contemplated in art. 103 of the TRLGDCU, in the case of providing info-products like those offered on this platform.

The right of withdrawal does not apply when:

Letter m: "The supply of digital content that is not provided on a material support when execution has begun with the prior express consent of the consumer and customer with knowledge on their part that consequently they lose their right of withdrawal."

Therefore, in the case of the powergrade: due to the type of digital product, which is downloaded after purchase, returns are not accepted.

Confidentiality

All information and documentation used during contracting, development and execution of the contractual conditions that regulate relations between MAINSTONE and the Client has a confidential nature. Information that is disclosed by agreement between the Parties, that which becomes public for the same reason, or that which must be revealed in accordance with laws or with a judicial resolution of competent authority, and that which is obtained by a third party who is not under any confidentiality obligation will not be understood as confidential information. Both parties undertake to comply with the duty of confidentiality and maintain it for a minimum period of two (2) years after finishing the mentioned contractual conditions that regulate MAINSTONE and Client relations.

All information received from the client, whether images, texts, access data such as users and passwords, hosting or others, will be treated confidentially, with transfer to third parties being totally prohibited unless we have their consent and always for the same purpose for which the data was obtained.

Exclusion of Liability

mainstone.rocks will not guarantee that the availability of the info-product or service object of this contract is continuous and uninterrupted, as well as data loss that may be hosted on its servers, interruption of commercial activities or any damage derived from the operation of services, or expectations generated to the Client, as a consequence of:

  • Causes beyond the control of mainstone.rocks and fortuitous causes and/or force majeure

  • Failures caused by incorrect use by the Client, especially those derived from contracting an inadequate service for the type of activity and use performed by the Client and/or third parties through their website

  • Scheduled stops and/or alterations in content made by mutual agreement between parties for maintenance or carrying out exceptional actions previously agreed upon

  • Viruses, computer attacks and/or other actions by third parties that cause total or partial impossibility of service provision

  • Incorrect or deficient Internet operation

  • Other unforeseeable circumstances

In this way, the Client accepts to bear these circumstances within reasonable limits, therefore expressly waives claiming from mainstone.rocks any contractual or non-contractual liability for possible failures, errors and use of the contracted service.

MAINSTONE will not be responsible in any case for errors or damages produced by inefficient and bad faith use of the service by the Client. MAINSTONE will also not be responsible for major or minor consequences due to lack of communication between MAINSTONE and the Client when attributable to non-functioning of the provided email or falsity of data provided by the Client in their mainstone.rocks user registration.

Causes for Contract Dissolution

mainstone.rocks may terminate or suspend any license for info-products contracted with mainstone.rocks immediately, without prior notice or liability, in case you do not comply with the conditions set forth herein.

Upon contract dissolution, your right to use the info-products will cease immediately.

Causes for contract dissolution will be:

  • Falsity, in whole or in part, of data supplied in the contracting process of any service

  • Altering, circumventing, reverse engineering, decompiling, disassembling or altering in any way the security technology provided by mainstone.rocks

  • Dissolution implies loss of rights over the contracted service

Intellectual Property and Prohibitions
